*UPDATED 7/6/18: WRA Condition Report Updates - Required July 1st

Recent legislation has required changes to a number of forms created by WRA. Below, please see a brief summary of those forms.

Real Estate Condition Report (RECR), the Vacant Land Disclosure Report (VLDR) Recent legislation modified the RECR, the VLDR. The new forms are required to be used effective July 1, 2018.

Previously, the WRA created a two-page RECR (WRA-CR "Condition Report") and a three-page RECR (WRA-SCR "Seller Condition Report"). The three-page form included supplemental explanation information for the seller. The law now includes such explanations and therefore, WRA has created only one RECR (Real Estate Condition Report).

Briefly, changes to the form include: the seller being posed a question rather than a statement; the form has checkboxes rather than lines; the report has been redesigned by offering categories such as structural and mechanical; environmental; well, septic and storage tanks; taxes, special assessment, permits; and land use. The form also provides examples to the seller examples of what types of defects might be included; offers explanation of yes responses in each section of the form rather than one for all explanations of yes responses; provides a statement reminding sellers that licensees are not permitted to answer seller's questions about whether an item is or is not a defect; and includes new disclosures.

All sellers required to complete a RECR or VLDRmust use the new report as of July 1, 2018. Any seller who has completed a RECRor VLDR prior to July 1, 2018 is not required to amend or complete a new report;only those who are completing a RECR or VLDR on July 1, 2018 and forward. If alisting is signed prior to July 1, 2018 but is not effective until July 1,2018, then the seller would need to complete the RECR or VLDR effective July 1,2018.
 

ImportantCorrection: Updated Info from WRA:

New versions of the RECR and VLDR with the updated content must be used when condition reports are furnished to buyers on or after July 1, 2018. For any reports already given out to buyers before July 1, there is no need to go back and provide a new form. If the buyer has been provided the RECR or VLDR before July 1, 2018, no further action need be taken. If the seller has completed the old RECR or VLDR before July 1, 2018, and the buyer will not be provided the RECR or VLDR until July 1, 2018, or after, then the seller must complete a new RECR or VLDR. Brokers with existing listings should be going back to the sellers and having them complete one of the new versions of the RECR/VLDR and use that starting July 1.

All sellers required to complete a RECR or VLDR must use the new report as of July 1, 2018. Any seller who has completed a RECR or VLDR prior to July 1, 2018 is not required to amend or complete a new report; only those who are completing a RECR or VLDR on July 1, 2018 and forward. If a listing is signed prior to July 1, 2018 but is not effective until July 1, 2018, then the seller would need to complete the RECR or VLDR effective July 1, 2018.

Seller Refusal/Statement Regarding the Condition Report (SRR) This form often serves as written evidence, when license law requires licensees shall ask the seller to provide written responses to the licensee's inquiry about the condition of the property. Generally, this response takes the form of a RECR or a seller disclosure report. However, when a seller refuses to complete a report and sell "as is," best practice for the listing firm would be to obtain written evidence that the licensee asked about the condition of the property and the seller refused to answer. This form has been subtly updated to reflect terminology update and entity signatures and acknowledgements.

Real Estate Condition Report - Farm (Farm RECR) The Farm RECR, based off of the RECR includes the revisions to the RECR as well as few additional farm-centric disclosures. For instance, the farm RECR includes: Property definition: provides the report applies to the land, dwellings, barns and outbuildings; Adds to storage of hazardous or toxic substances on neighboring properties: including dumpsites on the property where pesticides, herbicides, fertilizer or other toxic or hazardous materials or containers for these materials were dispose of in violation of manufacturer's or government guidelines or other law regulating said disposal; Wells adds: out-of-service wells and cisterns not closed/abandoned according to applicable regulations, and atrazine; Encroachments: references noncompliance with fence laws (See Wis. Stat. Ch. 90); Federal, state, or local regulations: includes and livestock siting violations (Wis. Admin. Code Ch. ATCP 51); Other defects: adds substantial crop damage from disease, insects, soil contamination, wildlife or other causes, diseased trees, or substantial injuries or disease in livestock on the property or neighboring properties; and Includes the Note: Any sales contract provision requiring inspection of a residential dumbwaiter or elevator must be performed by a state-licensed elevator inspect

Executive Summary
Separate legislation also effective July 1, 2018 made modifications to the Condominium Executive Summary. The revised Executive Summary includes new legislatively required items: the date of preparation, whether the association has a first right of purchase, any transfer fee, any disclosure material fee and any payoff statement fee.

RANW Bylaws Changes Approved by RANW Board of Directors June 26, 2018

These RANW Bylaws amendments were approved by the RANW Board of Directors on June 26, 2018. 

Amendments to the Bylaws are approved by the following process:
Article XVI Section 1a: Upon approval of amendments by the Board of Directors, such changes shall be noticed to the membership. Within thirty (30) days from the date of publication, all amendments shall automatically go into effect provided no petition from the membership has been received. If a petition signed by five percent (5%) of the members eligible to vote is received by the Association within thirty (30) days from the date of publication, the amendment(s) in question shall be submitted to the members for a vote, either at a membership meeting, or for a ballot vote by mail, at the option of the Board of Directors. Article XVI Section 3: Amendments to these Bylaws which are mandated by the National Association of REALTORS® shall become effective upon their approval by the Board of Directors at any regular meeting of the Directors at which a quorum is present.

Call for Action Seeks Flood Insurance Extension

The National Flood Insurance Program expires July 31st. Last week, NAR
issued a
Call for Action asking REALTORS® to urge their members of Congress to pass an extension to prevent the program from lapsing. The CFA also asks lawmakers to pass reforms that will improve the program for the long-term. 

Summer is Here - Time to Give to Direct Giver Program!

Summer is RANW's Direct Giver Fundraising period, and we are far short of meeting our goal. Given the importance of the upcoming November elections and pending issues such as reauthorizing the National Flood Insurance Program, we need your support now more than ever. So please send in your Direct Giver checks today.
The WRA Direct Giver Program provides an alternative to an RPAC contribution for members who wish to retain full control and direction over who will receive their political contributions. - wish to give personal contributions to candidates for local and state elections and at the same time benefit the REALTORS® Association.

Direct Giver Process

1. Solicitations: The minimum contribution is $100.00.
2. Checks: Checks can be used and must be made to the WRA Direct Giver Program (not RPAC). Checks can be sent to RANW, W6124 Aerotech Dr., Appleton, WI 54914.
3. Credit Cards: You may also pay on-line via credit card. Click here and login to the WRA site. Or you can call Jennifer at 920.739.9108 with your credit card information and she will take care of it.
4. Control: Contributions to the Direct Giver Program are deposited in a separate bank account from RPAC contributions. Structurally, the WRA then acts like a bank, with disbursements permitted only with the explicit authorization of the contributor. That is, you retain full control on how your direct giver money is spent.
5. Directing Contributions: Contributors may at any time direct their contributions, in whole or in part, to any candidate for local, state or federal office. When disbursing funds, contributors can email or call RANW or WRA to indicate how they wish their money to be distributed.

Agent Photos in Paragon - 3 Places to Upload/Check Image

Within the Paragon program, there are three different places where Agent Photos can be uploaded to appear on displays/reports/spec sheets, to the Email Signature, and to the Collab Center. Each photo placeholder is slightly different in size. When uploading the agent photo initially (under Preferences), the following apply:
1. 1280 X 960 Max resolution - system will compress higher resolution photos
2. JPG, PNG & GIF file types allowed - will be converted to JPG once uploaded
3. Special Characters (& , * , / , etc.) cannot be used in the file name.
4. There are no dimension requirements i.e. the photo can be rectangular or square. The agent photos on the report views will pull from the photo uploaded to the user's preferences. The default agent image dimensions on a report are 150 x 115 (rectangular), though those dimensions are customizable. For example, the Customer Full report currently has the agent image size set to 92 x 92 (square) and the Customer MLS View has the agent image size set to 147 x 112 (rectangular). The agent image will scale to fit the image size set on each report and will be limited by the larger dimension -- i.e the photo will be scaled down to fit and will not "stretch" to fit.

When setting up an email signature, the default agent photo size inserted is 105 x 117 (mostly square). The dimensions are customizable and can be edited, and the photo should scale to fit (and not stretch). The photo in the email signature can be customized by the user, and doesn't necessarily have to be the image from their Preferences.

On Collab Center, the image is stretched to fit the 100 x 100 image box, which can cause distortion on a rectangular image. The Collab Center image pulls from the user's Collab Center Preferences > About Me. Collab Center is the only location where the image proportions are absolute and can't currently be changed, so if an agent wants to have a single agent photo that works in all locations they will want to go with a photo that is more square than rectangular.

MLS Basics Class Offered ~ Tuesday, July 10th

Every MLS does things a little bit differently, so learn what RANW MLS needs you to know! The MLS Basics class will cover our rules and recommended listing procedures, offer a review of listing data and forms needed to complete your listings, cover some of the basics of using Paragon, and provide info on the Supra lockbox program.
This class is a great supplement to the Listing Input and Maintenance (LIM) training, and can be attended by new as well as long-time members and office admins who might like a refresher course.

MLS Note: Real Estate Condition Reports (RECR) and Vacant Land Disclosure Reports (VLDR) Changes

Paragon has a new document slot titled: July 2018 RE Condition Report 2017 Wis. Act 338, which is effective July 1, 2018, and updates the contents of the Real Estate Condition Reports (RECR) and Vacant Land Disclosure Reports (VLDR). The legislation focuses on when a report is furnished to the buyer and tells us a report needs to be on an updated form if the buyer is furnished with the report on or after July 1, 2018. Sellers should not provide buyers a copy of the new form until July 1, 2018.
A new document slot has been added to Associated Documents to allow members to upload the new July 2018 Real Estate Condition Report (on or after July 1). Members are asked to use this new label ONLY IF uploading the new version. This new label will allow members to see whether a new Condition Report has been added.

This new widget will help highlight new and existing Paragon functionality available to all users. Here you will find "did you knows?", tipsand tricks, as well as new features and updates designed to help you create a more efficient workflow and improve your experience in Paragon.
Quick Link to Last Searched Address
By popular request, Paragon now has the ability to select from the last five addresses pinned on the map. Just click the down arrow next to address and users can also select from key default addresses including Agent physical address, Agent mailing address, Agent office address, and board address (where applicable).
Long Description of Lookup Values
In order to aid new Agents who haven't yet memorized lookup codes, users now have the ability to enable long descriptions of lookup values. This option is off by default and can be enabled in the search options section of your user preferences.
Secured URL for Paragon and Email Notifications
In keeping with internet and security standards, Paragon and email notifications (Publink) are being upgraded to display in full SSL throughout those applications. In a future release, additional features such as Mobile, IDX, and the Client Collaboration Center will also be enhanced to full SSL. For the non-techies, Paragon is upgrading its security to protect you and your Clients' data.

New Construction Options Explained

RANW MLS now has 3 separate Yes/No fields that can be used to describe new construction listings. Of the 3 different options, only one can be marked as a Yes on any individual listing. See below for details on when each item would be used:
New Construction=Yes would be used if a home has been completed, and never lived in.
Under Construction=Yes would be if a home is not yet completed, but does at least have a street address and completed foundation.
To Be Built with Lot=Yes would be a lot with building plans (spec home) - a property that is not yet under construction. 

For all of these new construction types, the estimated completion date and Builder Name are also required.

Important:  Once the property has been completed (or sold), it should be moved to New Construction.  This keeps the MLS data integrity accurate and up-to-date for active and comparable searches.

Hotsheet vs. Market Monitor

Paragon has provided some details for RANW MLS members on the differences and similarities between the Hotsheet and the Market Monitor. The Listing Visibility field (Unconfirmed vs. Confirmed) and the definition of "New" for each tool are the items that can make these confusing.
Listings will not appear on the Market Monitor or the Hotsheet until they're Confirmed; but once the listing is confirmed, all prior changes can be seen on the Market Monitor or the Hotsheet by including the date the changes were actually made.
Hotsheet: The Hotsheet logs a listing as "New" when the listing is first created by the user (the "true" input date), but this "new" listing will not be viewable on the Hotsheet until it is confirmed by MLS staff.
Market Monitor: Listings are not shown on the Market Monitor under "New" until they are Confirmed. When a listing is Confirmed, a field rule updates the input date to the date the listing was Confirmed, which causes the listing to be added to the "New" section of the Market Monitor. This update of the input date via field rule does NOT update the "true" input date as far as the Hotsheet is concerned.
If a listing is input by the user and Confirmed by MLS Staff on the same day, the listing will appear in both the "New" section of the Market Monitor and the "New" section of a Hotsheet Search.
If a listing is input by the user but does not get Confirmed by MLS Staff until the next day (or later), the listing would show as "New" on the Hotsheet for the date it was input by the user - even if that date has already passed - but "New" on the Market Monitor for the date the listing was Confirmed by staff.

EXAMPLE:
10/19/17 - Listing is created
10/19/17 - Price is changed
10/23/17 - Expiration Date is changed
10/24/17 - Listing is Confirmed by staff

For the above listing, running a Hotsheet prior to when the listing was Confirmed on 10/24 would not return any results for this listing. After 10/24, the above changes will be returned in a Hotsheet search if the date the change was made is included in the specified time range. i.e. to see the Price Change, the Hotsheet search must include the date 10/19.
Similarly, for the above listing on the Market Monitor, it would be added as "New" when the listing was confirmed on 10/24. After the listing is confirmed, it could be found in the Price Change section as long as the "Days" back go far enough back to include 10/19.

WIREX and Door County MLS

The Door County MLS recently voted to cease participation in WIREX.  Effective July 1st, all Door County listings, offices and agents will be removed from WIREX.

Lockbox Program

Jammed Key Containers - Tips and Tricks

RANW has had a number of jammed key containers reported and returned. Here are some tips to prevent jamming the key container:

1. The Supra Bluetooth Lockboxes can hold up to five keys.
2. Do not turn the lockbox upside down when keys are already inside. This happens often when keyholders are attaching the lockbox to a doorknob. Try attaching the shackle to the doorknob and then placing keys in the key container. This will help you remember not to turn the lockbox upside down.
3. No rubber bands or key rings in the key containers. Labeling keys with stickers is fine.
4. Place the keys in the appropriate part of the key container. This is easy to find as it is labeled with a sticker depicting a key.
5. If your key container is jammed and the bluetooth cannot be activated, you can still release the shackle with a fob from the old iBoxes or with a loaner DisplayKEY from RANW. Contact information below. 
6. Please remember not to display the shackle code on any lockboxes. Any Supra keyholder can walk off with your lockbox if he or she has the shackle code. 

Having a lockbox cut off is very expensive. Utilizing these tips can save your office up to $100 in locksmith fees. If you have a lockbox that is jammed, please call RANW before tampering with the equipment.

REALTOR Ethics Requirement Deadline is 12-31-18

REALTORS® are required to complete ethics training of not less than 2 hours, 30 minutes of instructional time within two-year cycles.
The training must meet specific learning objectives and criteria established by the National Association of REALTORS®. A new two-year cycle began January 1, 2017. The deadline for this cycle is December 31, 2018.

New Fair Housing Resources

NAR opposes discrimination in housing based on race, color, religion, sex, handicap, familial status sexual orientation, gender identity, and national origin. This policy is embodied in NAR's Code of Ethics. NAR also authorizes sanctions in response to a finding that a member has violated any fair housing law, including local and state laws that prohibit discrimination based on sexual orientation or gender identity. NAR policy is to support equal opportunity on the basis of sexual orientation and gender identity and the NAR Code of Ethics was amended in 2010 and 2013, to include this updated policy.
