REALTOR Ethics Requirement Deadline is 12-31-18

REALTORS® are required to complete ethics training of not less than 2 hours, 30 minutes of instructional time within two-year cycles.
The training must meet specific learning objectives and criteria established by the National Association of REALTORS®. A new two-year cycle began January 1, 2017. The deadline for this cycle is December 31, 2018.
Training may be completed through the following options:

2017-2018 Legislative Summary - Most Successful Session Ever

By the end of the 2017-2018 legislative session, WRA had successfully attained 68 legislative victories on behalf of property owners and the real estate industry! What is even more amazing is that the majority of them were passed with bi-partisan support.
Please take a few minutes to
review this summary by WRA. It is critical that you are aware of these changes in state law so that you can utilize them on behalf of your clients and your business. Also, as we head into campaign season for the November elections, please remember to thank our state legislators for their support!

MLS

Important - Advertising without Agency Agreement No Longer Allowed

Advertising without Agency Agreement is no longer allowed in Wisconsin. WRA License Law Updates -2017 SB 455 relating to real estate practice was signed into law at the end of November with changes effective on 12.2.17: The law now requires a listing agreement in order to advertise a property. Newly created Wis. Stat. § 452.136 (3) states: Wis. Stat. § 452.136 (3) ADVERTISING WITHOUT AGENCY AGREEMENT PROHIBITED. A firm and any licensees associated with the firm may not advertise a property unless one of the following applies:
(a) The firm is the listing firm for the property
(b) The firm or a licensee associated with the firm has obtained consent to advertise the property from the listing firm for the property.

Collaboration Center School and Neighborhood Charts Updated

Paragon's Collaboration Center is getting an upgrade to School and Neighborhood charts and reports. These new improved charts and reports provide Collab Center users with the detailed information they need to evaluate the area surrounding the homes they are interested in. Dual Rate ~ Variable Rate Commissions - Must Be Disclosed in MLS

If you are not disclosing on your listing in MLS that there is a variable rate commission written in on your listing contract, you are violating MLS Rules that require you to disclose a VR commission. You must check Yes for that listing in MLS Paragon.
In case you are not sure what this is, please see a Summary in a WRA Legal Hottip from the last year, and if you have further questions, you should speak with your Company Broker/Manager:
Disclosing variable rate commissions is a required data field on every listing in MLS, per NAR Policy - this is not new.

Legal Hottip June 5, 2017 - Commissions More Information: Commissions/Compensation: Miscellaneous Commission Issues
QUESTION
The buyer's agent has been negotiating a co-broke transaction with another broker. Both agents wrote offers on the property that the other agent listed. The agent's buyer-client was best friends with the daughter-in-law of the seller, who told the buyer that the listing agent had given the seller a discount on the commission if he accepted his offer ($4,000). There was no disclosure in the MLS showing there were in-house concessions on the commission. The buyer's agent confronted the listing agent about this during the counter. The listing agent said he was advised that he did not have to disclose this information, and the buyer's agent told him that makes no sense as it is a pivotal part of the negotiation.
The listing agent finally confessed that he did have a 1 percent difference. The buyer's agent told him that if he presents the buyer's agent's offer, he wants a level playing field for the buyer with the same reduction in commission for the buyer-client. He agreed to tell this to the seller and as a result the offer was accepted.
Is he correct? If so, it is disturbing that the agent would not have all the facts and is not able to negotiate for buyer in a fair manner. The agent is fine with the 1 percent discrepancy but not with the nondisclosure. The listing agent said he had never had a problem with this before and that he does this all the time.
ANSWER
Variable rate commissions are addressed in the REALTOR® Code of Ethics as follows:
Standard of Practice 3-4
REALTORS®, acting as listing brokers, have an affirmative obligation to disclose the existence of dual or variable rate commission arrangements (i.e., listings where one amount of commission is payable if the listing broker's firm is the procuring cause of sale/lease and a different amount of commission is payable if the sale/lease results through the efforts of the seller/landlord or a cooperating broker). The listing broker shall, as soon as practical, disclose the existence of such arrangements to potential cooperating brokers and shall, in response to inquiries from cooperating brokers, disclose the differential that would result in a cooperative transaction or in a sale/lease that results through the efforts of the seller/ landlord. If the cooperating broker is a buyer/tenant representative, the buyer/tenant representative must disclose such information to their client before the client makes an offer to purchase or lease. (Amended 1/02) If the listing broker has a variable rate commission at the time of the listing, it should be identified as such in the MLS. When asked, the listing agent should share the differential between offers from the listing firm versus a cooperating firm.

Every MLS does things a little bit differently, so learn what RANW MLS needs you to know! The MLS Basics class will cover our rules and recommended listing procedures, offer a review of listing data and forms needed to complete your listings, cover some of the basics of using Paragon, and provide info on the Supra lockbox program.
This class is a great supplement to the Listing Input and Maintenance (LIM) training, and can be attended by new as well as long-time members and office admins who might like a refresher course.

New Version of Supra eKEY for iPhone, iPad or iPod Touch

Attention eKEY Users with iPhone, iPad or iPod Touch: A new version of the Supra eKEY app for iOS devices (iPhone, iPad and iPod Touch) has been released. This new version resolves an issue that was affecting inputting the PIN code on devices using iOS versions 10 to 10.3.2. Supra recommends updating devices to the highest iOS version possible. This ensures the latest security patches are received. See steps below.

Steps To Update Your iPhone,iPad or iPod Touch:
~ Plug your device into power and connect to the Internet with Wi-Fi. If you have a data plan that includes the internet, you do not need to connect to Wi-Fi (wireless Internet).
~ Tap Settings > General > Software Update. Tap Download and Install.
~ If a message asks to temporarily remove apps because iOS needs more space for the update, tap Continue or Cancel. If you tap continue, you are able to choose which apps or media to delete in order to free up more space. ~ If you tap Cancel, you will still need to delete media or apps on your device in order to make space for the update. We recommend backing up pictures/videos using Google Drive, other online storage sites such as Dropbox or storing the pictures to your desktop computer while your device is plugged in via USB cable. Once you have enough space you can once again tap Settings > General> Software Update and then tap Download to install. ~ Please visit Apple Support for more information and helpful how-tos:

You may also need to uninstall and reinstall the eKEY application from your Apple Store (App Store). To reinstall the eKEY app:
1. Uninstall your current eKEY app by holding down on the app logo until it starts to shake. At this point an 'x' will appear in the upper left side. Tap the 'x' to remove the app.
2. Visit your App Store and search for Supra eKEY.
3. Tap 'Get' or 'Install' next to the Supra eKEY logo in search results
4. Once downloaded, you must generate an authorization code via your SupraWEB account, by calling RANW MLS at (920)739-9108, or by emailing aschilling@ranw.org or khubers@ranw.org.
5. Tap 'activate eKEY' after opening your eKEY app and enter the 30 digit authorization code.
6. If you have not set up a SupraWEB account yet, visit Supraekey.com and select 'Register for new agents'. Once registered, on the left hand side of your home screen in SupraWEB, your multiple options include authorization code and pin code. You need to select authorization code. This temporary, 24 hour, 30 digit code must be entered into your iPhone, iPad, or iPad Touch eKEY app to activate the eKEY. This code is temporary and can only be used once, however, a separate authorization code may be generated each time you may need to reinstall the app.

Did You Get a New Phone? Need an Authorization Code?

Did you get a new phone and need an authorization code for your eKEY app? You have the power to generate these codes using your SupraWEB account!

Visit
Supraekey.com and click on the big purple button that reads "Login for Real Estate Agents".
~ Then select new user registration. SupraWEB will ask you to set up your account by making up a username, password, and to choose security questions. SupraWEB will then ask you for your serial number and pin code. Your serial number and pin code was sent to you via e-mail when your eKEY was activated.
~ Please hold on to this information. Working eKEY apps have the key serial number right on top of the screen while the app is open.
~ When your account has been set up, the home screen will list a number of different options on the left hand side of the screen. These options include AUTHORIZATION CODE, Change your Pin, and other helpful tools such as Set Up Market Area and Add Keybox.
~ Once you have selected AUTHORIZATION CODE, your SupraWEB account will generate a 30 digit code that you will type (five numbers per box for six boxes) into your newly downloaded eKEY app after selecting Activate eKEY in the open eKEY app.
~ This code is a one-time use temporary code. You will have to generate a new code each time you switch devices with eKEY.

Lockbox System Use Clarification

The RANW MLS Supra Lockbox System is available for REALTOR® Member Companies in MLS and for RANW Affiliate Member Home Inspectors who are licensed or registered Home Inspectors in the State of Wisconsin. Please see the following further clarifications regarding the purpose of the RANW MLS Lockbox system and the limitations on members' use of the system and Lockbox Keys:

Purpose

(1.) REALTOR® Keyholders:
(a) A REALTOR/MLS Subscriber Keyholder shall use the Key only for the intended purpose of gaining authorized entry into property listings submitted to RANW MLS on which a System Lockbox has been installed, and only as relates to the sale or purchase or appraisal of said property for clients and customers and only as authorized by the listing company in advance.

(b) A REALTOR® Keyholder may use their Lockbox Key to open a listed property for a third party if authorized in writing by Seller and Listing Company as relates to the sale, purchase or appraisal of the property.

(2.) Affiliate Home Inspector Keyholders:
(a)  An Affiliate Home Inspector Keyholder shall use the Key only for the intended purpose of gaining authorized entry into real property on which a System Lockbox has been installed, and only for the limited purpose of performing services specifically authorized under the terms of the Offer to Purchase/Addenda in the Home Inspection and/or Testing provisions, subject to prior authorization from the listing company, and all other authorization limitations and elsewhere in the Affiliate Lockbox Agreement.

Further,
(b) Only employees of the Home Inspector Company who are also Registered Home Inspectors and authorized Keyholders may access a property listed in MLS via their respective assigned Key to perform work as authorized above in (a)and (b). 
(c)  An Affiliate Home Inspector Keyholder may not use their Lockbox key to let an employee of their company who is not an authorized Keyholder into the property unless they are under director supervision of Keyholder.
(d) An Affiliate Home Inspector Keyholder may not use their Lockbox Key to let in a third party, or an employee of another company, into the listed property.

The Affiliate Home Inspector Company may not use the privilege of access to the MLS Lockbox System in advertising related to their Home Inspection or other company (ies).

All Keyholders:  Prior Authorization from Listing Company
Having a Key does not allow automatic access to properties in MLS. All Keyholders must have prior written authorization from the listing company to access the property for each visit.
