DSPS Real Estate License Renewal Deadline ~ Monday, December 14th
The Wisconsin Department of Safety & Professional Services (DSPS) license renewal deadline is fast approaching!
Renewal Notification
The DSPS will notify licensees through email, so it is important to make sure your contact information is up-to-date with the DSPS. The license renewal will open up approximately six weeks before the due date, so around early November. The DSPS will send out a courtesy reminder email at that time. After the renewal has begun, licensees will be able to log in and renew their real estate sales or brokers licenses at the following link: User Log-in If you do not know your PIN, please use the link below: Pin Look-up
License Renewal & CE Upload
The DSPS requires the completion of four mandatory and two elective CE courses to renew your real estate license by 12-14-20.
When licensees renew online they will be asked to confirm course title, school/sponsor, course dates and CE hours. For more information on how to check at www.wra.org for classes you've taken, click here and enter your myWRA login and password.

FINAL RANW Dues Deadline is Thursday, Dec 31st
The final dues deadline is Thursday, December 31st. The easiest way to pay is online at www.ranw.org. The red dues button links to a new member portal, but the process is the same: just use your member ID or NRDS number and follow the steps. More features of the member portal will be launched in the next few months. Watch www.ranw.org and the newsletter for updates.

NAR Approves Changes to Code of Ethics Article 10 and Statement of Policy 29
NAR's Board of Directors on November 13th approved a series of recommendations that extend the application of Article 10 of the Code of Ethics to discriminatory speech and conduct both related to and outside of members' real estate practices, strengthening REALTORS®' commitment to upholding fair housing ideals.
Article 10 prohibits REALTORS® from discriminating on the basis of race, color, religion, sex, handicap, familial status, national origin, sexual orientation, or gender identity in the provision of professional services and in employment practices. The NAR Board approved a new Standard of Practice under the Article, 10-5, that states, "REALTORS® must not use harassing speech, hate speech, epithets, or slurs" against members of those protected classes.
The NAR Board also approved a change to professional standards Policy #29, expanding the Code of Ethics' applicability to all of a member's activities (unless otherwise provided for in specific Articles) and added guidance to the Code of Ethics and Arbitration Manual to help professional standards hearing panels apply the new standard.
Finally, NAR Directors approved a revision to the NAR Bylaws, expanding the definition of "public trust" to include all discrimination against the protected classes under Article 10, along with all fraud, and clarifying Associations' requirements in sharing with the state real estate licensing authority, final ethics decisions holding REALTORS® in violation of the Code of Ethics in instances involving real estate-related activities and transactions where there is reason to believe the public trust may have been violated.
The NAR Board made these changes effective immediately, although the changes cannot be applied to speech or conduct that occurred before the effective date. More information, along with an FAQ, can be found here.

The following slate of nominees previously presented by the Nominating Committee for election to the RANW Board of Directors has been deemed by the Board to be uncontested and elected to the 2021 RANW Board: Michael Sewell, Pat Kaster, Diane Campshure-Walczyk, K.C. MLS
MLS RULE: Report Offer Statuses Within 24 Hours
Section 4.15 Contingencies Applicable to Listings-Reporting of Offer Statuses reads, in part: All Offer Status changes … shall be specified and reported to the MLS … within 24 hours (excepting weekends, holidays, and postal holidays)…. Listings that include a provision that such disclosures may not be made through MLS, even if directed by the seller, are ineligible for inclusion in MLS. Listings stating such a restriction will not be accepted, and if amended with such restrictions after filing, listing will be withdrawn by MLS.
When all contingencies to the Accepted Offer have been met, the listing should be placed in the Pending status until it closes. Days on Market is calculated from the List Date to the Pending Date.
NAR & DOJ Settlement on MLS Policies
The National Association of REALTORS (NAR) recently advised members of a lawsuit filed by the Department of Justice against NAR over certain MLS policies; a settlement was subsequently reached by both parties. NAR President Charlie Oppler and NAR General Counsel Katie Johnson issued a statement regarding the settlement. The intro to the statement follows.
STATEMENT from National Association of REALTORS (NAR):
"Today, NAR reached an agreement with the U.S. Department of Justice (DOJ) to make certain changes to the Code of Ethics and NAR MLS policies regarding providing information about commissions and MLS participation. We are making these changes to address questions raised by the DOJ, and even though NAR disagrees with the DOJ's characterization of our rules and policies, by reaching this agreement NAR will be able to remain focused on supporting our members as they preserve, protect, and advance the American dream of homeownership.
Although the exact language is still being finalized, most of the changes seek to more explicitly state what is already the spirit and intent of NAR's Code of Ethics and MLS policies regarding providing information about commissions and MLS participation."

MLS Policy Changes Approved by NAR - Effective Early 2021
NAR's Board of Directors approved eight recommendations (unrelated to the DOJ settlement) on November 13th aimed at bringing more consistent standards to REALTOR®-owned MLSs across the country regardless of size. The recommendations strengthen accountability on the part of both MLSs and their Participants (broker members) and subscribers (agents or brokers affiliated with a participant) in four areas: Compliance, Data, Governance and Services. Under NAR policy, Participants are required to submit accurate listing data and correct known errors. The new standards emphasize this obligation and outline specific administrative and other enforcement procedures of MLS Rules regarding data accuracy, as well as cooperation.
Under the new rules, MLS participants and subscribers who receive more than a minimum number of administrative sanctions in a year will be required to attend a hearing(s) for subsequent infractions; their broker would be notified and would also need to attend any hearing. And for data errors, the recommendations would require MLSs to have the option of processing complaints without revealing the complainant's name. RANW MLS already has this in place with the "police" function in Paragon. NAR also clarified policy requiring MLSs to include in any API data feeds the same access and information as in RETS data feeds. And in an administrative clarification, MLSs must display customer service and technical support contact information on their websites. Consistent with NAR's ACT fair housing action plan, MLSs are now also required to put in place a process for identifying potential fair housing law violations in listing content and advising participants and subscribers to remove or correct potential violations. RANW MLS has had a screening process in place for many years.
The required rules go into effect January 1, 2021, and the local implementation deadline is March 1, 2021.

How the Pending Status Affects Your DOM
DOM (Days on Market) for RANW MLS listings is calculated from the List Date to the Pending Date, which would be the date any/all contingencies to an accepted offer have been met, and the listing is no longer taking offers (see definition from MLS Rules below). The status change from an Active status to the Pending status must, by MLS Rules, be submitted to MLS or entered into LIM immediately upon occurrence. When a listing is put into the Pending status, the clock stops on the DOM calculation. If something were to happen at that last minute that caused the sale to fall through, the listing can be brought back to Active and the time spent in the Pending status would not be counted in the DOM.

PENDING: Accepted Offer with no contingencies; it is ready to close. Pending properties are also are included in the RETS feeds for posting by most member and public websites. Pending date to be entered immediately, not to wait for posting closed information in MLS.

REALTORS® are required by NAR to complete ethics training of not less than 2 hours, 30 minutes of instructional time within three-year cycle.
