Lynn Schwarm Retiring!Lynn Schwarm is retiring as RANW MLS Director at the end of January. Lynn has been with RANW since we became RANW, and was the Executive for the Oshkosh Realtors Association when we merged - a total of 39 years! For every one of those years, Lynn has shown an exceptional commitment and loyalty to the Realtors and Affiliates in Northeast Wisconsin. She is loved and respected by both staff and leadership and has guided us all with passion and integrity.
There really are no words to express our gratitude for the opportunity to have worked with such an extraordinary person whose heart is as big as her commitment. Our wish for a Happy Retirement could not be more sincere and no one deserves it more. Wishing you the best life has to offer in this next chapter, Lynn. We will miss you! Revisions to the Real Estate Condition Report and Vacant Land Disclosure Reports - 2022Recent legislation clarifies a prior inconsistency in the statutes as far as buyers who rescind their offer being entitled to the return of their earnest money. A buyer who should have, in accordance with Wis. Stat. § 709.02, but who does not receive a Real Estate Condition Report (RECR) or Vacant Land Disclosure Report (VLDR) within 10 days after acceptance of their offer has rescission rights. That buyer may, within two business days after the end of that 10-day period, rescind the offer by written notice. The new legislation states that beginning April 1, 2022, that buyer is entitled to the return of their earnest money. Wis Stat. § 709.02 previously did not provide that the buyer was entitled to their earnest money in this circumstance.
Another change addressed under the new legislation is the situation where a seller puts a huge "X" on each page of the RECR or VLDR, or places a diagonal line through each page of the report rather than answering the questions. Starting April 1, 2022, these reports will be considered incomplete; a report will be considered complete only if the seller answers or supplies information for each item on the report. A buyer who receives a report that is incomplete may, within two business receipt of that report, rescind their offer in writing and is entitled to the return of their earnest money.
The legislation also adopts changes and additions to the disclosure items in the RECR and VLDR. These items have been in italics in the WRA's RECR and VLDR for over a year. The italics will be removed on April 1, 2022, and July 1, 2022, for the riparian rights disclosures. In the WRA's RECR, the following language addressing private rights of way, piers on flowages and FIRPTA that is currently in italics will become part of the statutory disclosure language:
F8. Other than public rights of way, are you aware of nonowners having rights to use part of the property, including, but not limited to, private rights of way and easements other than recorded utility easements?
F17m. Are you aware of a written agreement affecting riparian rights related to the property?
F17n. Are you aware that the property abuts the bed of a navigable waterway that is owned by a hydroelectric operator?
Under Wis. Stat. s. 30.132,the owner of a property abutting the bed of a navigable waterway that is owned by a hydroelectric operator, as defined in s. 30.132 (1) (b), may be required to ask the permission of the hydroelectric operator to place a structure on the bed of the waterway.
G4m. Is the owner a foreign person, as defined in 26 USC1445 (f)? (E.g., a nonresident alien individual, foreign corporation, foreign partnership, foreign trust, or foreign estate.) Section 1445 of the Internal Revenue Code (26 USC 1445), also known as the Foreign Investment In Real Property Tax Act or FIRPTA, provides that a transferee (buyer) of a U.S. real property interest must be notified in writing and must withhold tax if the transfer or (seller) is a foreign person, unless an exception under FIRPTA applies to the transfer.

February 9, 2022 | Madison Concourse Hotel and Governor's Club It's time to lobby! The WRA's annual lobbying event, REALTOR® & Government Day, is your chance to shape the laws that affect you and your real estate business in Wisconsin.
The event kicks off with an issue briefing where you'll learn about pending laws and how they impact real estate. Next, you'll move to the Capitol for lawmaker visits. You'll have the unique opportunity to meet in person with your state lawmakers to lobby for or against these laws.
This is your chance to advocate for issues that impact the real estate industry, homeownership and property rights in Wisconsin. Your voice will be heard, and a better Wisconsin real estate market will follow.

Beginning in January of 2022, cellular providers will begin turning off their 3G networks.
Why: They are taking this step because as technology evolves and improves, they remove older services.
What you need to do: For eKEY users that are using older devices, we suggest that you check with your cellular provider to determine if your phone requires a 3G network to function.
This will impact very few of you, but if you are unsure if you have a 3G device, please take a moment to read the document linked HERE. This document lists the minimum requirements of your device in order to run the eKEY app and how to update.
Supra will also attempt to directly contact keyholders that are affected and advise them to update to the current eKEY app version.
